Terms of Service

1. Acceptance of Terms

By accessing and using the Reztro platform ("Service", "Platform"), you ("User", "Restaurant", "Customer") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. Reztro reserves the right to update or modify these Terms at any time without prior notice, and your continued use of the Service constitutes acceptance of those changes.

2. Description of Service

Reztro provides a cloud-based restaurant management software designed to facilitate QR-based ordering, kitchen display systems (KDS), analytics, staff management, and multi-branch administrative tools. The Service is provided on a Software-as-a-Service (SaaS) basis, meaning access is granted via a web-based platform subject to active subscription status.

3. Account Registration and Security

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and update such information to keep it accurate, current, and complete.

  • You are responsible for safeguarding your password.
  • You agree that you will not disclose your password to any third party and that you will take sole responsibility for any activities or actions under your Reztro account.
  • You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Subscription, Billing, and Payments

Reztro offers various subscription plans (e.g., Starter, Pro, Enterprise). By selecting a plan, you agree to pay Reztro the monthly or annual subscription fees indicated for that service.

  • Billing Cycle: Charges are billed in advance on a monthly or yearly basis depending on the chosen plan.
  • Refunds: Payments are non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.
  • Price Changes: Reztro reserves the right to modify subscription prices with at least 30 days prior notice.

5. Acceptable Use Policy

You agree not to misuse the Reztro platform. Misuse includes, but is not limited to, the following activities:

  • Using the Service for any unlawful purposes or to conduct any illegal activity.
  • Attempting to gain unauthorized access to the Service or its related systems or networks.
  • Interfering with or disrupting the integrity or performance of the Service.
  • Reproducing, copying, duplicating, selling, or reselling any part of the Service without express written permission from Reztro.
  • Uploading malicious code, viruses, or any other destructive software.

6. Data Ownership and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain all rights to the restaurant data, customer data, and order history you process through Reztro. You grant Reztro a license to use, host, and process this data solely for the purpose of providing the Service.

Reztro takes data security seriously and implements industry-standard protocols to protect your information, but cannot guarantee absolute security against all cyber threats.

7. Termination

Reztro may terminate or suspend your account and access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or cancel your subscription from your billing dashboard.

8. Limitation of Liability

In no event shall Reztro, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service; and
  • Unauthorized access, use, or alteration of your transmissions or content.

9. Disclaimers

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the applicable jurisdiction in which Reztro operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
